1. Introduction
Welcome to SailnGreece (“we,” “us,” or “our”). These Terms and Conditions govern your use of our website www.sailngreece.com and the services we offer, including yacht charters and related services. By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please discontinue use of our website and services.
2. Definitions
- Client: The individual or entity who books a yacht charter through SailnGreece.
- Charter Operator: The owner or operator of the yacht provided for charter.
- Vessel: The yacht or boat provided for charter.
- Crew: Skipper, hostess, cook, or any professional personnel provided during the charter.
- Extras: Additional services or equipment requested by the Client that incur extra charges.
3. Booking and Confirmation
3.1 Booking Process
- Inquiry Submission: Clients submit an inquiry with preferred dates, vessel type, number of guests, and any special requests.
- Quotation: We provide a quotation based on availability and preferences.
- Confirmation: Booking is confirmed upon receipt of the required advance payment as per the payment terms.
- Booking Confirmation: A booking is only confirmed when the full amount of the advance payment has been received and the Charter Operator has confirmed the booking.
3.2 Payment Terms
- Advance Payment: A non-refundable deposit of [Insert Percentage]% of the total charter price is required to confirm the booking.
- Final Payment: The remaining balance is due [Insert Number] days before the charter start date.
- Payment Methods: Payments can be made via bank transfer. All bank charges are the responsibility of the Client.
- Failure to Pay: If payments are not received by the due dates, we reserve the right to cancel the booking without refund.
4. Pricing and Inclusions
4.1 Charter Price Includes
- Use of the vessel and its standard equipment as per the inventory list.
- Auxiliary boat with oars.
- Standard base services during check-in and check-out.
4.2 Charter Price Excludes
- Fuel costs.
- Port fees, marina fees, and mooring charges.
- Provisioning (food and beverages).
- Crew services unless explicitly included.
- Additional services and optional extras not specified in the charter agreement.
- Value Added Tax (VAT) increases that occur after booking confirmation.
5. Additional Services and Extras
- Extras must be requested and agreed upon at the time of booking confirmation or no later than 10 days before the charter start date.
- Availability of Extras requested after booking confirmation is not guaranteed.
- Extras may include, but are not limited to:
- Skipper
- Hostess or cook
- Water sports equipment
- Wi-Fi
6. Crew and Skipper
6.1 Hiring Professional Crew
- If a professional skipper or crew is required, it must be requested at the time of booking.
- Clients without a valid skipper’s license must hire a professional skipper.
- The cost of the crew is the responsibility of the Client and must be paid as per the agreed terms.
6.2 Client’s Responsibilities towards Crew
- Clients and guests must treat the crew with professional respect.
- The crew must be provided with adequate rest and meals during the charter.
- Any misconduct towards the crew may result in termination of the charter without refund.
7. Documentation and Crew List
- A completed Crew List must be submitted at least 10 days before the charter start date.
- Clients must provide valid identification documents for all passengers.
- It is the Client’s responsibility to ensure all passengers have valid visas and comply with immigration regulations.
- A valid skipper’s license must be provided if the Client intends to skipper the vessel.
8. Cancellation Policy
8.1 Cancellation by Client
- More than 60 days before charter start date: 35% of the total charter price is forfeited.
- Between 30 and 60 days before charter start date: 65% of the total charter price is forfeited.
- Less than 30 days before charter start date: 100% of the total charter price is forfeited.
- No-Show or Early Abandon: Treated as a cancellation with 100% forfeiture.
8.2 Cancellation of Crew Services
- Cancellation fees for skipper, hostess, or cook apply separately and are charged at the same rates as vessel cancellation fees.
8.3 Cancellation by SailnGreece or Charter Operator
- In case of unforeseen circumstances rendering the vessel unavailable, we will:
- Offer an alternative vessel of similar specifications.
- If no suitable alternative is available, provide a full refund of amounts paid.
9. Changes and Modifications
- Minor Changes: Subject to an administrative fee of €45.
- Major Changes: Subject to availability and an administrative fee of €300.
- All changes must be requested in writing and are not guaranteed.
10. Security Deposit
- A refundable Security Deposit is required before embarkation, payable in cash or credit card as per the Charter Operator’s policy.
- The deposit covers any damage or loss caused during the charter period.
- The deposit is refunded after the charter, provided no damages or losses have occurred.
- Hiring a professional skipper does not exempt the Client from providing a security deposit.
11. Insurance
- The vessel is insured against marine risks with a deductible franchise equal to the security deposit amount.
- Personal belongings and activities are not covered.
- Clients are advised to obtain personal travel and health insurance.
12. Check-In and Check-Out Procedures
12.1 Check-In
- Clients must arrive at the agreed time and location for vessel handover.
- An inventory and condition check will be conducted.
- Any discrepancies or issues must be reported immediately.
12.2 Check-Out
- The vessel must be returned to the agreed marina by the specified time, typically with a full fuel and water tank.
- A final inspection will be conducted.
- Late returns may incur additional fees.
13. Sailing Area and Restrictions
- The basic sailing area is specified in the vessel’s registration documents.
- Sailing outside the designated area requires prior approval and may incur additional costs.
- Clients must adhere to local laws and regulations, including but not limited to:
- Not sailing under the influence of alcohol or illegal substances.
- Respecting night-rest hours in marinas and harbors.
- Not participating in races or regattas without written consent.
14. Client’s Obligations and Responsibilities
- Competency: Clients must be nautically and navigationally skilled or hire a professional skipper.
- Vessel Care: Clients must operate the vessel with due care and avoid negligent behavior.
- Compliance: Clients must comply with all local laws, maritime regulations, and Charter Operator’s terms.
- Crew Conduct: The Client is responsible for the conduct of all passengers on board.
15. Damages and Losses
- Clients must report any damages or losses to the Charter Operator immediately.
- Failure to report incidents may result in the Client being held liable for all associated costs.
- In cases of gross negligence, the Client may be liable beyond the amount of the security deposit.
16. Liability and Indemnity
- SailnGreece’s Liability: Limited to the amount paid by the Client for the charter services.
- Client’s Liability: Clients are liable for any damage, loss, or legal violations occurring during the charter.
- Indemnity: Clients agree to indemnify and hold harmless SailnGreece and the Charter Operator from any claims arising from the Client’s actions.
17. Complaints and Disputes
- Reporting Issues: Any issues must be reported immediately to allow for prompt resolution.
- Formal Complaints: Must be submitted in writing within 14 days after charter completion.
- Dispute Resolution: Parties will strive to resolve disputes amicably before resorting to legal action.
18. Force Majeure
- Neither party shall be liable for delays or cancellations due to events beyond their control, such as natural disasters, war, or other force majeure events.
- In such cases, alternative arrangements or refunds will be considered on a case-by-case basis.
19. Governing Law and Jurisdiction
- These Terms and Conditions are governed by the laws of Greece.
- Any disputes shall be subject to the exclusive jurisdiction of the courts in Athens, Greece.
20. Changes to Terms and Conditions
- We reserve the right to modify these Terms and Conditions at any time.
- Changes will be effective upon posting on our website.
- Clients are advised to review the Terms and Conditions periodically.
21. Severability
- If any provision of these Terms and Conditions is found to be unenforceable or invalid, the remaining provisions shall remain in effect.
22. Entire Agreement
- These Terms and Conditions constitute the entire agreement between the Client and SailnGreece and supersede any prior agreements or understandings.
